　　甲方根据《中华人民共和国城市房地产管理法》及有关规定，已依法通过划拨方式取得北京市____区(县)____地块的国有土地使用权，土地使用面积为____平方米，国有土地使用证件为____。甲方在上述地块上建设的____，现已具备规定的预售条件，经北京市房屋土地管理局批准，准予上市预售，经济适用住房销售许可证号为京房内证(经)字第__号。

　　乙方自愿购买甲方的____房屋，房屋用途为普通住宅。乙方预购房屋的定金为人民币____元。双方经协商，就该房屋的预售预购事项订立本合同。

　　甲方出售该房屋时亦同时将该房屋所占用范围内的划拨土地使用权转让给乙方，土地使用面积(含分摊的共有共用面积)为____平方米，该土地使用面积为甲方暂测面积，房屋竣工后以测绘部门实测面积为准。

　　第二条　甲方双方同意，结算房价款时，房屋的实测建筑面积与暂测建筑面积的误差不超过暂测建筑面积的±__%(含)时，按照本合同第三条所述房屋单价据实结算;房屋建筑面积误差超过上述约定幅度时，自甲方向乙方出示测绘部门实测面积数据之日起__日内，甲乙双方同意按下述第____种(大写)方式处理：

　　第五条　本合同签订后，因甲方变更其建筑设计而影响乙方购买房屋的套内面积、平面布局和使用空间的，应于__日内书面通知乙方。乙方于收到通知之日起__日内有权解除本合同。合同解除自乙方书面通知送达甲方之日起生效。甲方在解除合同之日起30日内须将乙方已付的购房价款及利息退还乙方(利息计算同第五条)，并向乙方双倍返还定金。甲方变更建筑设计不告知乙方的，乙方有权解除本合同，甲方除应退还乙方已付的房价款及利息(利息计算同第五条)，并向乙方双倍返还定金外，还应承担补充协议中双方约定的违约责任。

　　第六条　甲方同意按《建设工程质量管理办法》、《北京市建设工程质量条例》及有关规定、自竣工房屋交付之日起对乙方购置的房屋进行保修。

　　第七条　乙方同意在小区物业管理委员会或业主管理委员会未选定物业管理机构之前，其购置的房屋由甲方或甲方拽定的物业管理公司负责管理。

　　第八条　双方同意在签订本合同后三十日内，持本合同和有关证件共同到北京市____房地产交易管理部门办理预售、预购登记手续。

　　第九条　双方同意房屋符合交用条件时按规定共同到房地产交易管理部门办理房屋买卖过户手续，申领房地权属证件，并按规定交纳有关税费。

　　第十条　本合同在履行中如发生争议，双方应协商解决。协商不能解决的，双方同意按以下第__种(大写数字)方式解决纠纷。

　　五、 保证金 deposit

　　3. 因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用，甲方可在保证金中抵扣，不足部分乙方必须在接到甲方付款通知后十日内补足。

　　in case party b breaches this contract， party a has right to deduct the default fine， compensation for damage or any other expenses from the deposit . in case the deposit is not sufficient to cover such items， party b should pay the insufficiency within ten days after receiving the written notice of payment from party a.

　　六、 甲方义务 obligations of party a
